Impeachment critic Rep. Ken Buck calls on Kamala Harris, Cabinet to oust Joe Biden using 25th Amendment

Outgoing Rep. Ken Buck, a past critic of impeaching President Biden, wants Vice President Kamala Harris to move against her boss.

The 65-year-old Buck (R-Colo.) introduced a resolution Monday calling on Harris, 59, to convene a Cabinet meeting and invoke the 25th Amendment, which requires the veep and a majority of the Cabinet to declare Biden, 81, “incapable of executing the duties of his office.”

The Republican lawmaker cited special counsel Robert Hur’s damning 388-page report, released earlier this month, that raised questions about the president’s mental acuity.

Hur alleged that Biden “willfully retained and disclosed classified materials,” but declined to press charges citing concerns that a jury would likely see him as a “well-meaning elderly man with a poor memory.”

Biden’s team vehemently refuted Hur’s characterizations of the president’s forgetfulness and also slammed the media for highlighting portions of the report suggesting that Biden knowingly kept some of the classified material.

When Biden, 81, attempted to rebut the Hur report in a presser, he referred to Egyptian President Abdel Fattah as “the president of Mexico,” fueling concerns about his age.

“Numerous instances were articulated in the report, and have played out in full public view, showing President Biden’s apparent cognitive decline and lack of mental stamina,” Buck said in a statement.

“The societal challenges and security threats our country faces are innumerable and require a chief executive with both strong mental and physical faculties. The time has come for the vice president and the Cabinet to put our country first and move forward on invoking the 25th Amendment.”

Ironically, Buck was fiercely critical of House Republicans’ push to open an impeachment inquiry into Biden last fall, arguing that his party was “relying on an imagined history.”

An impeachment inquiry is distinct from actual impeachment proceedings to remove a president but it is generally meant to be a step in that direction.

Then-House Speaker Kevin McCarthy (R-Calif.) initiated the probe Sept. 12 without a floor vote due to a lack of support within the party. In December, Buck joined his fellow Republicans in formalizing the impeachment inquiry, despite his prior criticisms.

More recently, Buck opposed Republican efforts to impeach Homeland Security Secretary Alejandro Mayorkas for alleged dereliction of duty. On Feb. 13, the House impeached him in a 214-213 vote. Buck was one of the three Republicans opposed.

The 25th Amendment was adopted in 1967 to provide for contingencies in the case of presidential death, removal, resignation or incapacitation following the assassination of John F. Kennedy four years earlier.

Critics of former President Donald Trump floated his ouster via the same method during his administration.

Buck is far from the only Republican to muse about employing the 25th Amendment against Biden. Others such as Rep. Claudia Tenney (R-NY) and even Trump himself have dangled the idea.

Biden is the oldest president in US history, and a myriad of polls have noted unease among Americans about his octogenarian status.

A recent ABC News/Ipsos poll found that 86% of voters believe the president is too old to serve another term, while 62% felt the same way about Trump, 77.
